Cannot use new_rewrite

i read the post there http://www.amember.com/forum/threads/rewriterule-doesnt-work-in-htaccess-files-on-this-server.2465/, i made the test alex told me, and tried to load the file
http://yoursite.com/amember/data/tests/new_rewrite/1.php
but i have an error, that means the htaccess file is loaded which is the case, when i use ftp program to see it.

But i cannot use new_rewrite to protect the folder it says " (RewriteRule doesn't work in .htaccess files on this server)"

i have a cms on the subfolder that has its own htaccess file, maybe it is the problem?
